1. Market Turning Points is the publisher of stock market information of interest to investors and traders.

2 www.marketurningpoints.com is a web site operated by Market Turning Points.

3. "The publication" refers to the newsletter, the web site, and its associated email system.

Terms:

1. Market Turning Points allows subscribers access to its newsletter and its Real-time Alerts service on a subscription basis.

2. Market Turning Points may discontinue the publication of this service at any time and without recourse.

3. Subscribers make their own decisions and make all trades in their own accounts with appropriate advice. Market Turning Points only provides stock market information. It does not give investment or trading advice, and it does not manage funds.

Disclosures:

1. Andre Gratian, the founder of Market Turning Points is not a licensed securities analyst. Investing in the stock market can (and does) involve risk. Persons who are not intimately familiar with the markets are strongly advised to seek expert counsel before making investment decisions.

Hold Harmless:

1. By subscribing to the Market Turning Points email newsletter, web site, and associated email alerts, the subscriber warrants as follows:

a. They agree to hold Andre Gratian harmless from any trading losses that may incur from their use of the stock market information provided for them.

b. They acknowledge that they understand that there is substantial risk in trading the stock market, and further avow that they have either sought appropriate professional advice, or declined to seek such advice at their own risk and peril.

c. They release Andre Gratian, Market Turning Points, and any person associated with Market Turning Points, from any actions, suits, torts, or other actions for any damage whatsoever arising out of their use of any of the information received from Market Turning Points in connection with this subscription.

Subscription Fees:

1. The subscriber agrees to pay a fee of $265.00 to initiate access to the site, the newsletter and timely email alerts for a period of one year from the date of subscription.

2. The subscriber understands that Market Turning Points reserves the right to change the terms of the subscription at any time, but that this will not affect his current subscription. The subscriber also has a choice of subscribing on a quarterly instead of yearly basis. The subscription fee per quarter is $75.00

Cancellation.

1. Market Turning Points reserves the right to terminate any subscriber at any time without cause or recourse.

2. A subscriber may cancel participation by simply notifying Market Turning Points. In this case, a $100.00 deductible will be applied.

3. In the event of cancellation, whatever the cause, a pro-rated refund of the paid subscription fee will be made to the subscriber.
